COVID and Lasting Powers of Attorney

December 2020

As none of us can predict the future the current COVID pandemic has made us rethink our lives. Many families are stuck and cannot access bank accounts of loved ones in ICU or hospital to pay their bills or care fees. So it is important to try and plan ahead. A recent news story Kate Garraway of GMTV and her husband Derek Draper appear to show them both in this difficult position and they are only in their 50s. Ms Garraway may not be able to access her husband’s sole accounts nor can she deal easily with his finances nor his health arrangements.
Lasting Powers of Attorney (LPAs) can offer peace of mind and if your loved one has lost capacity a Deputyship will offer similar protections for the family. We are happy to discuss this with you.

Wills and COVID

December 2020

Making a Will is straightforward and is something many people worry about often unnecessarily. Most Wills can be dealt with easily enough by filling out our Questionnaire which we can email over and we can discuss your wishes and see if they are practical but if there’s some complexity or a delicate situation say because of a blended family or a family home which may need a life interest trust in favour of your 2nd or 3rd spouse then we can assist. We deal with all types of Wills,
The BBC reported over the Summer 2020 that Wills can now be witnessed via video link. With Zoom Teams and FaceTime it seems Solicitors can now cover most of the work remotely which takes the pressure off those who are self isolating or in hospital.

Inheritance - Who pays tax

December 2020

For the tax year 2020/21 everyone is allowed to leave an estate valued at up to £325,000 free of tax plus in addition they can leave the new 'main residence' band of £175,000 giving a total allowance of £500,000 per person. Anything under this will mean that beneficiaries will not pay any inheritance tax.

The nil rate band amount is decided by the Government and means you are taxed at a nil rate up to the £500,000.

Above that amount, anything left is subject to tax of 40% (or 36% if you leave at least 10% of your assets to a charity).

So if you leave assets in 2020/21 worth £600,000 and you own just one property), your estate will pay nothing on the first £500,000, and 40% on the remaining £100,000 – a total of £40,000 in tax.
